NOTICE OF PUBLIC HEARING

Pursuant to A.R.S. Section 9-462.04(A)(1), Notice is hereby given that the Litchfield Park Planning and Zoning Advisory Commission and the Litchfield Park City Council will hold public hearings at the dates and times set forth below to consider adoption of an ordinance to amend the City of Litchfield Park Zoning Code.

THE LITCHFIELD PARK CITY COUNCIL PUBLIC HEARING

WILL BE HELD ON WEDNESDAY, DECEMBER 13, 2017 AT 7:00 P.M.

The City proposes to amend the Zoning Code of Litchfield Park.  The amendments are generally described as follows:

Amending Section 2 Definitions, Subsection 2.04 Definitions to revise Group Home for the Handicapped to Group Home and amend the definition and add new definitions for Group Living Facilities, Recovery Residence, and Single Housekeeping Unit;  Amending Section 28 Zoning Matrix/District Requirements Summary to add Group Homes as an allowed use in Medium Density Multifamily (MFM) Districts and adding Recovery Residences as an allowed use in in Residential Estate (RE), Low Density Residential (R1), Low Medium Density Residential (R1-15), Medium Density Residential (R1-8), High Medium Density Residential (R1-6), High Density Residential (RC), Low Density Multifamily (MFL), Medium Density Multifamily (MFM), High Density Multifamily (MFH), Patio Home Residential (PH), Planned Development (PD), Public Facility (PF), and Commercial-Flex (CF) when developed as residential Zoning Districts, all subject to the regulations set forth in new Section 31.17 Group Living Facilities; Amending Section 31 General Regulations to delete Subsection 31.17 Group Homes for the Handicapped in its entirety and to add new Subsection 31.17 Group Living Facilities with additional subsections including:  Purpose – Setting forth the purpose for the new section; Registration Required – Requiring that a registration form be submitted to the City at least 30 days prior to beginning operations, that the City make a final decision regarding the registration within seven working days of receiving a complete registration form, that the registration become effective upon issuance of a Certificate of Occupancy for the Group Living facility and terminate when the facility use ceases, that no registration shall be accepted that does not comply with the requirements of the Zoning Code or has been granted a reasonable accommodation, that zoning confirmation may be obtained from the City prior to registration, and that any change to the contact information provided on the registration form must be reported to the City within ten working days; Group Homes permitting Group Homes in all residential zoning districts, with occupancy of such homes limited to a maximum of eight residents per home, not including staff,  requiring compliance with all City Codes, ordinances, and regulations, requiring a separation distance of 1,200 feet between Group Living Facilities while allowing that a smaller or greater separation may be required based on traffic generated and/or if the existing and proposed facilities are separated by a significant intervening physical feature, requiring current license, certifications or registration, adding regulations relating to garbage and trash collection, requiring that the exterior appearance shall be consistent with the residential character of the neighborhood appearance, requiring that no Group Home shall house any person whose tenancy would constitute a direct threat to others or would result in substantial physical damage to others, and setting forth that a Group Home for the Developmentally disabled with a maximum of six residents, not including staff, is allowed in a residential area as mandated by State Statutes; Recovery Residences:  Setting forth that Recovery Residences are permitted in residential zoning districts as set forth in Zoning Code Section 28 Zoning Matrix/District Requirements Summary, requiring that an Operations and Management Plan (O&MP) be submitted with the required Registration form to ensure compliance with state and local laws, setting forth the items that must be included within the O&MP, setting forth standards for Recovery Residences including compliance with O&MP submitted, a separation distance of 1,200 feet from another Group Living Facility, maximum occupancy of two residents per bedroom, including the house manager, requiring a live-in house manager, requiring the exterior appearance to be consistent with the residential character of the neighborhood, requiring on-site parking  in compliance with City regulations, and that prohibiting Recovery Residences from housing any person whose tenancy would constitute a direct threat to others or would result in substantial physical damage to others; Reasonable Accommodation:   Providing that a Group Living Facility owner may request for a reasonable accommodation from the requirements under certain circumstances and providing a process for  submittal and review of the request, and the criteria to be considered in approving, modifying, or denying the request; Changes in Federal or State Law:  Setting forth that should Federal or State laws be amended so as to not require the Group Living Facility use in a residential zoning district, any use established pursuant to the section shall cease.  The effect of the amendments will be to update the City Zoning Code to conform with recent changes in the law and to provide reasonable regulations for Recovery Residences.
