NOTICE OF PUBLIC HEARING
Pursuant to A.R.S. Section 9-462.04(A)(1), Notice is hereby given that the Litchfield Park Planning and Zoning Advisory Commission and the Litchfield Park City Council will hold public hearings at the dates and times set forth below to consider adoption of an ordinance to amend the City of Litchfield Park Zoning Code.

The City proposes to amend the Zoning Code of Litchfield Park. The amendments are generally described as follows:
Adding a new Section Commercial Flex (CF) District with additional subsections including: Land Use Definition - setting forth that the Commercial Flex District will provide for commercial centers which provide everyday goods and services for a number of neighborhoods, but also provide for residential uses if certain conditions are met; setting forth that all uses permitted in the Community Commercial district are permitted in compliance with the property development standards set forth in Zoning Code Section 22 Community Commercial (CS) District, and that accessory uses and temporary uses require use permit approval; Use Regulations - setting forth that a building or premise in this district shall only be used for the purposes as set forth in the Litchfield Park Zoning Matrix (Section 28); Property Development Standards - setting forth that the requirements of Section 22 Community Commercial (CS) shall apply to the district except as modified as follows: the property shall have a minimum area of twelve acres, and single-family residential uses are permitted in compliance with certain requirements. The requirements for development for single family residential uses are that a Development Agreement shall be entered into with the City governing the development of the property that sets forth the circumstances under which the property may be used for residential uses. If the circumstances permitting a residential use exist, no commercial use shall be developed and the following property development standards will apply for residential uses: 1) the density shall not exceed 5.5 dwelling units per acre; 2) the minimum lot area per dwelling unit shall be 6,000 square feet; 3) residences shall have a livable floor area of at least 1,200 square feet; 4) the maximum lot coverage shall be 50% of the lot area; 5) the minimum distance between buildings on the same lot shall be 10 feet; 6) buffer yards shall be provided between dissimilar uses or other districts; 7) at least 20% of the net site area shall be open space; 8) the height of all structures shall not exceed the lower of two stories nor 35’ from natural grade; 9) there shall be a front yard setback of at least 10’, and where a lot is located at the intersection of two or more streets, there shall be a setback conforming to the front setback requirements on each street side of a corner lot; 10) a side yard setback of at least 10’ shall be provided, except that, on the street side, the side yard setback shall be 20’, unless adjacent to a 10’ landscape tract, in which case the side yard setback shall be at least 10’; 11) there shall be a rear yard setback of not less than 20’; 12) all streets within the project shall be private; 13) any exterior lighting shall be directed downward and away from adjacent property; 14) provisions for on-site storm water retention/drainage and off-site storm water drainage shall be as required by the City of Litchfield Park and the Maricopa County Flood Control District; 15) parking requirements set forth in Section 29 that are applicable to High Medium Density residential (R1-6) shall apply; 16) requirements for walls, landscaping, and fences set forth in Section 30 shall apply; 17) signage requirements as set forth in Section 35 applicable to High Medium Density Residential (R1-6) shall apply.
The proposed amendment will also amend Section 38 Zoning Matrix District Requirements Summary to add the new Commercial Flex (CF) Zoning District along with the development standards and uses allowed therein.
